Am I 'technically' allowed to carry at work with these policies? (California)


The text from the employee handbook. In reading through it, it appears the company neglected to think that someone may be capable of CCW in California and has, therefore, not added any specific rules for California regarding CCW. Based on the lack of any additional California rules, it appears I'm 'technically' allowed to CCW at work here because I am 'specifically allowed by state law.'It's an interesting loophole; not something I'm particularly interested in testing, but I thought you all may find it interesting. Weapons Prohibition The Company expressly prohibits team members from possessing or carrying any firearms or other weapons deemed inappropriate in the workplace while in Company offices, on Company property, in Company vehicles, or on Company business, except where specifically allowed by state law. The definition of weapons is at the sole discretion of the Company. Additional information for team members in Arizona, Florida, Kansas, Louisiana, Missouri, Texas, and Utah can be found in the Appendix. Appendix example, taken from Texas: TEXAS Weapons Prohibition The Company does not permit any owner, team member, agent, or representative (“team member”) to carry or maintain a handgun or firearm on the Company’s premises. A team member is permitted to bring a handgun into a parking garage/lot provided the team member has a handgun license and the vehicle remains locked. The weapon must remain inside the locked vehicle and cannot be brought into the Company’s premises. It is also the policy of the Company to prohibit the carriage of a weapon or firearm on your person or property while you are performing any services or attending any function relating to your employment with the Company or conducting any business on its behalf. Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter Company premises with a concealed handgun. Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter Company premises with a handgun that is carried openly. A license to carry the weapon does not supersede Company policy in the building. All Company team members are subject to this provision, including contract and temporary team members, as well as visitors and clients on Company premises. If at any anytime, the Company has a reasonable suspicion that a weapon or firearm has been carried, maintained, or stored in violation of this policy, the Company reserves the right to conduct a reasonable search of the person or property which it suspects possesses or contains a firearm. The violation of this policy or your refusal to consent to a search conducted according to this policy may lead to disciplinary action, suspension, or termination of employment.
