Some States have a Duty to Retreat on the books or (like the state I'm in) in case law. Roughly, Duty to Retreat means you have to try to escape a situation rather than fight. I'm not sure how you prove that you tried to escape but my very limited understanding based on a case in my own state is that if you cannot prove you tried to escape before using deadly force you're looking at 2nd degree murder.In the context of a mass shooting in a State where you have a Duty to Retreat you could face criminal prosecution if you engaged the shooter rather than retreating (if that was an option for you).We've had discussions before on how we might handle a situation like being in a mass shooting and there are two camps, the John McClane camp (Yippie-Ki-Yay, Motherfucker!) and...well I don't think they make movies about the 2nd camp which is, Take care of yourself and your loved ones.So now the John McClanes have another thing to consider, are you in a Duty to Retreat State?
