Draw, but not fire - failed to call police.


A friend of mine from a pistol training class had an interesting experience last week. He and his wife were driving through a local grocery store parking lot. A guy in a BMW (with a female companion) cuts him off...friend literally had to swerve his truck to miss the guy. Friend honks his horn. Guy flips him off. Friend honks horn again. BMW stops, blocking the parking aisle, steps out of his car and throws his full soda cup at the windshield of friend's truck. BMW driver then proceeds to charge towards truck. Friend throws truck into reverse to exit the situation. BMW guy chases him on foot. Friend gasses truck to increase distance. Then friend stops truck, steps out after instructing wife to lock truck, and pulls his concealed carry gun. BMW guy immediately hot foots it back to car, jumps in, and speeds away. Friend holsters gun, gets in truck, parks for a moment to regain his composure and subsequently drives away.Friend is 60+ and not in the best of shape. He described BMW driver as average height, somewhere in his 30s or 40s, and noticeably muscular (BMW guy was apparently wearing a sleeveless T-shirt). Friend stated he definitely feared for his physical safety: "the guy was running towards me and screaming that he was going to beat me to a pulp."Keep in mind that I'm only getting one side of the story here. The mind is a funny thing when it comes to recalling the facts of a high-stress event. But, for the moment, let's go with the idea that friend's story is accurate. I suspect, given the age difference between friend and BMW guy, friend was probably justified in drawing his firearm (at least under Utah law). My concern is that he did not call the police before leaving the scene of the event. BMW driver, or even a bystander eyewitness, could have called the police with their own version of the event...which would have made friend look a bit suspicious for not calling first.So I thought I'd throw this out for consideration by the experts here. You draw your CC pistol in self-defense, but not shots fired and situation resolves itself.
