What should of happened in this situation?


So I just got off of the phone with my father who was recently held and charged for aggravated assault. He was observing a couple in a argument from a distance and the woman took notice. She said a pretty rude remark in which my father replied with a snarky comment of his own (which I didn't think was very smart he should had just kept it to himself.) after the two exchange their remarks he walks inside of a supermarket and comes out 10 minutes later. When he comes out the same couple he had the exchange with ealier had two more people with them (m/f) the woman from the first encounter started to swing at my father. This for obvious reasons doesn't warrant him to draw because she doesn't have the ability to do harm but then the two other men begin to chase after my dad where my dad starts jogging away to retreat but he sees that they are still chasing him. He then draws and presents his firearm in a low ready position and tells them to stop which they comply. My dad gets into his car, drives away and is stopped 4 blocks by a LEO where he is arrested, processed and charged. The charges are later dropped and my dad is released but his firearm has been confiscated along with his carry licence. The charges were dropped because of a video from the market that showed the altercation. I'm not defending my dad because what he said wasn't very smart but the matter is when he presented his firearm in your opinion was he justified in pulling firearm to defuse the situation in this case? This isn't meant for legal advice I just want to know when would had been the right time to draw in this case.TL;DR My dad drew his gun on two able bodied males (25+) and a woman after being chased for a few yards. Police took his gun and CW license,processed and charged him. Charges were dropped but I want to know in your opinion was drawing in this situation was justified?Also since the charges were dropped doesn't this mean he can go for his CW license and gun or does he have to wait for a response from the police to pick up his belongings? and does this affect his ability to renew his CW license?My Father is around 50 and this happened in Philadelphia via /r/CCW http://ift.tt/1XyUNiE
