Charlottesville Shooting - Will he go to jail?

The shooter has been arrested for discharge of a firearm within 1,000 feet of a school.I imagine he'll claim Self Defense (thus falling under rule 1(b) of this sub).PLEASE: Let's discuss if this was lawful/reasonable self defense. Let's ignore the reasons for the rally and the attendant issues.My thoughts is that it was not lawful/reasonable self defense (or defense of others).While the other person did ignite some kind of spray, which I would consider lethal force, it was short lived and at the time the shot was fired it was possible no longer present (out of frame at least). The key, however, is that the shooter fired into the ground intentionally which means he did not think it necessary to use lethal force but only necessary to fire a "warning" shot which is almost always a bad idea.I would say drawing was legal but the threat appears to have abated, as evidenced by him shooting into the ground vs shooting the person with the improvised flame thrower. Also he walked away potentially leaving the person with the flame thrower free to attack others. He clearly felt safe reversing his direction (as he'd already walked past the person) to go back to the situation so why wouldn't he stay to secure the scene pending police arrival? I'm not suggesting he act like a LEO but provide protection. Instead he calmly walks away. It is possible the other person ran away and he should NOT pursue.I think he'll either plead down or end up convicted for the illegal discharge.Thoughts? via /r/CCW http://ift.tt/2wj6Ruj
