Philly may charge people who did NOT intervene in rape. While there is nothing in this article, or any other that I’ve read, to say that anyone was carrying, this is a good “food for thought” situation.I read many posts in this sub, and other gun subs, along the lines of “not my circus, not my monkeys” so they gun owner won’t get involved.I’m not saying that’s wrong given that intervening can lead to serious legal and financial issues even if you do everything right. But here they may criminally charge people for not intervening.Often cops/DAs say “don’t get involved and take the law into your own hands, call 911 and be a good witness.” But now they seem to be saying get involved or get charged. And will this allow the rape victim to civilly sue those that didn’t intervene?Cops don’t have a duty to intervene:Warren v MPDTown of Castle Rock v GonzalesLozito v NYCBut now apparently citizens do have a duty to intervene?Added resources:SEPTA does not explicitly ban real guns (but do ban toy guns) but guns could be banned under several of the categories. While this is old, SEPTA responded to an inquiry saying guns are NOT banned, but they prefer people not carry.I suspect that SEPTA would ban guns but for PA Preemption laws. via /r/CCW https://ift.tt/3AVflaC
